In the State of Kansas when you transfer your vehicle you need to complete the odometer reading on the back of the vehicle’s Certificate of title. You have to complete the odometer disclosure statement in the Assignment of title section on the back of the vehicle’s title. Please note that the odometer disclosure statement is mandatory for all vehicles model year 2011 or newer, self-propelled, and with a registered weight of 16,000 lbs. or less.
These vehicle types are exempt from odometer disclosure requirements in the State of Kansas: any vehicle model year 2010 or older, any vehicle over 16,000 pounds, non-motorized vehicles (trailer-type), low-speed vehicles (LSV), and scooters or mopeds.
Also a separate Odometer Disclosure Statement might be necessary in certain situations. The Kansas Department of Revenue provides two state-approved fillable PDF forms to be used in certain situations.
For example you may use the Odometer Disclosure Statement Form TR-59 if the back of the title is filled or is not in compliance with the regulations. Or if the vehicle’s Certificate of title doesn’t contain the odometer reading section. Or in the case you need to make a correction to the odometer disclosure statement. Also when you need to transfer a vehicle without a title (legal affidavit or court document). In these cases you can use the Form TR-59. Also you can complete this form as well to keep a sale record along with a copy of the assigned title. See more details below.
In the case your Title is being held electronically (E-Title) you need to use the Odometer Disclosure Statement Form TR-40. As of January 2003, the Kansas Division of Vehicles will not issue a vehicle title of any type when there is a lien recorded on it. See more details below.
According to the federal and state law the seller has to state the mileage upon transfer of ownership. Providing a false statement may result in fines and/or imprisonment!
