Florida Odometer Disclosure Statement – FL

In the State of Florida when you transfer the ownership of your vehicle you need to complete the odometer disclosure statement on the front of the vehicle’s Certificate of title in the Transfer of Title by Seller section. In certain cases you may also use one of the two state-approved forms to complete the odometer disclosure statement. The federal and state laws require to state the current mileage with the transfer of ownership for any vehicle model year 2011 or newer, self-propelled, and with a registered weight of 16,000 lbs. or less. The following types of vehicle are exempt from odometer disclosure requirements in the State of Florida: any vehicle model year 2010 or older and vehicles with a gross vehicle weight rating (GVWR) of more than 16,000 pounds. Also vehicles that are not self-propelled, non-motorized vehicles (trailer-type), mopeds or scooters, low-speed vehicles (LSV), and Off-Highway vehicles are exempt from odometer disclosure.

It is very important to read all the instructions on the Certificate of title before you start to write on it. Be careful because any erasure or alteration will void the title! Also use a pen with blue or black ink and not a pencil.

You should know and understand that failure to complete or providing a false odometer statement may result in fines and/or imprisonment!

In some cases you may need or want to complete the state-approved Form HSMV 82993 – Separate Odometer Disclosure Statement And Acknowledgment. You may use this form also to record a private transaction. Doing so the seller can prevent future claims from the buyer. It is a good practice for the seller to keep a copy of the assigned title (front and back) and of this odometer disclosure form for five years.

Section 1

In the first section the seller completes first the vehicle’s details and then certifies the odometer reading. So here complete first the VIN Number, Year, Make, Color, Body style/type and Title Number of the vehicle.

Next check if the odometer has five or six digits and complete the current odometer reading and date. Complete the current odometer mileage by using only digits without tenths. Then check the first check box if the reading reflects the Actual Mileage. Or check the second check box if the current odometer reading is in excess of the mechanical limits of the odometer. Or check the third check box if the current odometer reading is not the actual mileage (WARNING – ODOMETER DISCREPANCY):

Section 2

In the second section the seller first signs and completes his/her full PRINTED name. So please write SELLER’S NAME using only Capital Letters. Next complete seller’s address, city, state, and ZIP code:

Section 3:

In the last third section the buyer acknowledges the above odometer certification made by the seller(s). Then the buyer signs on this form and completes his/her full PRINTED name. Finally complete here buyer’s address, city, state, and ZIP code:

If you need to use the state-approved fillable Form HSMV 82042 – Vehicle Identification Number And Odometer Verification, this form is composed of two parts. Please use only black or blue ink when you complete this form by hand. Below you will see how to complete this state-approved form:

Part A

In the first part the seller completes first the current date. Then completes the vehicle’s details and then certifies the odometer reading. So complete first the VIN Number, Year, Make, Color, Body style/type and the previous state the vehicle was titled in.

Then check if the vehicle’s odometer has five or six digits. After that complete the current odometer reading and date. Fill in the current odometer mileage by using only digits without tenths. Next check the first box if the current odometer reading reflects the Actual Mileage. Or check the second box if this odometer reading is in excess of the mechanical limits of the odometer. Or check the third box if this current odometer reading is not the actual mileage (ODOMETER DISCREPANCY).

Following the buyer or purchaser acknowledges the above facts stated by the seller and signs. Then the owner or purchaser completes his/her full PRINTED name.

Part B

DO NOT complete the second part. Part B is reserved for certification by a Notary Public, Florida Compliance Examiner / Inspector (DMS/TC Employee), Military Police Officer / Law Enforcement Officer or by a Florida Licensed Dealer:

In the State of Florida you may need or want to complete the Florida Odometer Disclosure Statement FormForm HSMV 82993 (Rev. 11/11). You SHOULDN’T use this form when a Florida title which was issued on or after April 29, 1990 is available. You also SHOULDN’T use this form when an out-of-state title, which conforms to federal law, is used to transfer a motor vehicle. Also DON’T use this form when a Form HSMV 82994 or HSMV 82995, motor vehicle Dealer Title Reassignment supplement or Power of Attorney/Odometer Disclosure were used. However you may use this form to record a private vehicle transaction.

When you want to apply for a Florida title for an out of-state used motor vehicle, including trailer, not currently titled in Florida, with a net weight of 2,000 pounds or more you need to complete the state-approved Vehicle Identification Number And Odometer VerificationForm HSMV 82042 (Rev 01/15/21). However you DON’T need to use this form for a new motor vehicle, regardless of whether it was purchased in Florida or out of-state. Also you DON’T need to use this form for mobile homes, trailers or semitrailers with a net weight of less than 2,000 pounds, trailers type recreational vehicle (travel trailers and camp trailers) or off-highway vehicles.

How to complete the Florida Odometer Disclosure Statement

When you complete at the time of sale the Odometer Disclosure Statement on the front of the vehicle’s Certificate of title in the Transfer of Title by Seller section you have to complete the following details.

The seller completes first the purchaser’s (buyer’s) full PRINTED name. Please write BUYER’S NAME using only Capital Letters. Next complete purchaser’s or buyer’s address, city, state, and ZIP code.

Then complete the selling price and the date of sale.

Following the seller states and certifies the current odometer reading. First check if the odometer has five or six digits. Next complete the odometer mileage reading and reading date. Please use only digits without tenths when you complete the actual mileage of the vehicle. Lastly check the first box if the odometer reading reflects the Actual Mileage. Otherwise the seller can check the second box if the mileage stated is in excess of the odometer’s mechanical limits. Or the seller can check the third box if the Odometer reading is NOT the actual mileage (Odometer Discrepancy).

Next the seller(s) signs and completes his/her PRINTED full name(s). Finally the purchaser or the buyer acknowledges the odometer certification made by the seller(s) and needs to sign and to complete his/her full PRINTED name(s).
