Kentucky Odometer Disclosure Statement – KY

In the Commonwealth of Kentucky when you transfer the ownership of your vehicle you have to complete the odometer statement on the vehicle’s Certificate of Title. If you sell the vehicle to a dealer you complete the odometer reading on the front of the title, in the Dealer Only section. If you transfer your vehicle to a private buyer you need to complete the odometer statement on the back of the title, in the Transfer of Title by Owner section. It is mandatory to complete the odometer disclosure statement for any self-propelled vehicle model year 2011 or newer and with a registered weight of 16,000 lbs. or less. Be careful because when you transfer your vehicle, the seller must sign on the title in the presence of a notary.

These types of vehicles are exempt from odometer disclosure in the Commonwealth of Kentucky: all vehicles model year 2010 or older, vehicles with a GVWR over 16,000 pounds, non-motorized vehicles (trailer-type), low-speed vehicles (LSV), and mopeds or scooters.

Also read all the instructions on the Certificate of title before you start to write on it. Pay attention because any erasures, mutilations or alterations will void the title!

In certain situations and for your own records you may complete a separate official Odometer Disclosure Statement Form TC 96-5 as well. For example, in a private transaction, you can use the TC 96-5 Form to record the details of the buyer in addition to a copy of the assigned Certificate of title. The federal and state law requires to state the vehicle mileage in connection with the transfer of ownership according to KRS Section 190.300. Please be careful because failure to complete or providing a false statement may result in fines and imprisonment under KY odometer law!

Following complete again the seller’s full printed name and the current odometer reading. Please complete the current odometer reading by using only digits without tenths. However if the current odometer reading is in excess of the mechanical limits of the odometer check the first box. And if the current odometer reading is not the actual mileage please check the second corresponding box.

Lastly complete the transfer date but DO NOT SIGN on the form because you need to sign in front of a Notary Public:

In the last fourth section complete first the buyer’s full printed name. Please write BUYER’S NAME using only Capital Letters. Then complete here buyer’s phone number, address, city, state, and ZIP code. Finally complete the current date:

Or check the second check box if the Odometer reading is NOT the actual mileage (Odometer Discrepancy).

Next complete the transferor’s (seller’s) printed full name. Please write SELLER’S NAME using only Capital Letters.

Finally complete the date of transfer but DO NOT SIGN on the title! You have to sign on the title in front of a Notary Public:

Odometer Fraud in Kentucky

If you think you may be a victim of odometer fraud please try first to resolve the problem with the seller. But if you cannot find a solution you should file a complaint with the Kentucky Consumer Protection Division, the Kentucky State Police or the Federal Bureau of Investigation. You will have to submit a copy of the purchase agreement, the title, and of the odometer statement.
